Eden: Natural Birth & Pregnancy, LLC (“Eden,” “we,” “us,” or “our”) operates an informational website and a mobile application designed to provide educational resources and tools to help expectant parents create personalized birth plans.

The Services provide general educational content related to pregnancy and birth planning. The Services are designed to support — not replace — the relationship between you and your healthcare provider.

THIS IS FUNDAMENTALLY IMPORTANT: Eden does not provide medical advice, diagnoses, or treatment. The Services are not a medical device and are not intended to function as one.

All information provided through the Services — including articles, blog posts, birth plan templates, educational content, and any other materials (collectively, “Content”) — is for general educational and informational purposes only. The Content is not intended to be a substitute for professional medical advice, diagnosis, or treatment.

Always seek the advice of your physician, midwife, or other qualified healthcare provider with any questions you may have regarding a medical condition, your pregnancy, or your birth plan. No information provided through the Services creates a provider-patient relationship between you and Eden, its founders, employees, or contributors.

THE SERVICES ARE NOT FOR MEDICAL EMERGENCIES. IF YOU BELIEVE YOU OR SOMEONE IN YOUR CARE MAY BE EXPERIENCING A MEDICAL EMERGENCY, CALL 911 (OR YOUR LOCAL EMERGENCY NUMBER) IMMEDIATELY. DO NOT RELY ON THE SERVICES FOR EMERGENCY MEDICAL NEEDS.

You use the Services at your own risk. You acknowledge and agree that:

• There is no guarantee that using the Services will result in a successful, healthy, or complication-free pregnancy, labor, delivery, or postpartum experience.
• Every pregnancy and birth is unique. Information that applies to one person may not apply to you or your circumstances.
• Medical research and clinical guidelines evolve. Content may not reflect the most current medical evidence or may not be applicable to your specific situation.
• You are solely responsible for the decisions you make regarding your pregnancy, birth plan, and healthcare, and for discussing those decisions with a qualified healthcare provider.
• Reliance on any information provided through the Services is solely at your own risk.

All content on the Services — including text, graphics, logos, images, and software — is the property of Eden: Natural Birth & Pregnancy, LLC or its content suppliers and is protected by copyright and intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from any content without our prior written consent, except for personal, non-commercial use of downloadable resources we explicitly provide (such as our free birth plan template).

When using the Services, you agree not to:

TO THE FULLEST EXTENT PERMITTED BY LAW, EDEN DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Without limiting the foregoing, Eden makes no representations or warranties about:

• The accuracy, reliability, completeness, correctness, or timeliness of any Content.
• The accuracy, completeness, or usefulness of any opinions, advice, or other information provided through the Services.
• That the Services will be uninterrupted, error-free, or free of viruses or other harmful components.
• That any particular birth outcome will result from the use of the Services or reliance on the Content.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, EDEN: NATURAL BIRTH & PREGNANCY, LLC AND ITS FOUNDERS, MEMBERS, MANAGERS, EMPLOYEES, AGENTS, AFFILIATES, AND CONTRIBUTORS (COLLECTIVELY, THE “EDEN PARTIES”) SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, data, or goodwill.
• Personal injury, bodily harm, emotional distress, or death arising from your use of or reliance on the Services or any Content.
• Pregnancy complications, birth outcomes, or any adverse health event experienced by you, your child, or any person in your care.
• Any action or omission you take or fail to take based on information or Content provided through the Services.
• Any failure to obtain medical treatment, or any delay in obtaining medical treatment, related to your use of the Services.

THE EDEN PARTIES' TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU HAVE PAID TO EDEN FOR USE OF THE SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS (USD $100).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE EXCLUSIONS OR LIMITATIONS MAY NOT APPLY, AND YOU MAY HAVE ADDITIONAL RIGHTS.

You agree to indemnify, defend, and hold harmless the Eden Parties from and against any and all claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

• Your use of or reliance on the Services or any Content.
• Your violation of these Terms.
• Your violation of any rights of another party.
• Your violation of any applicable laws, rules, or regulations.
• Any decision you make regarding your pregnancy, birth plan, or healthcare based on information obtained through the Services.

This indemnification obligation will survive the termination of your use of the Services and these Terms.

The Services may contain links to third-party websites or resources. We are not responsible for the content, accuracy, or practices of any third-party sites and do not endorse them. Accessing third-party links is at your own risk.

We reserve the right to modify these Terms at any time. Changes will be effective when posted on this page with an updated “Last updated” date. Your continued use of the Services after changes constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.

These Terms shall be governed by and construed in accordance with the laws of the State of Iowa, without regard to its conflict of law provisions.

Any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall be resolved exclusively in the state or federal courts located in the State of Iowa, and you consent to the personal jurisdiction of such courts.

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be enforced to the maximum extent permissible, and the remaining provisions of these Terms shall remain in full force and effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Eden regarding your use of the Services and supersede all prior agreements, understandings, and communications.
